- Preliminary
- These terms and conditions of sale are concluded, on the one hand, by DNC TAG sprl, hereinafter referred to as "the seller" and, on the other hand, by any natural person (acting as a professional or consumer) or legal entity wishing to make a purchase via the seller's website (http://www.safe-t.eu), hereinafter referred to as "the buyer".
- b) A consumer is any natural person acting for purposes not related to their commercial, industrial, craft, or liberal activity.
The consumer has the right to inform the seller that they are waiving the purchase, without penalty and without giving any reason, within 14 calendar days from the day following the delivery of the goods, subject to the exceptions mentioned in Article 9 of these general terms and conditions of sale (see below).
- General
2.1 By placing an order on the website, the buyer explicitly accepts the general terms and conditions of sale, which are available on the website at all times, and agrees to each and every one of these conditions, whether general or specific.
Consequently, the buyer waives their own purchase conditions, including payment terms and delivery conditions. Any deviation must be made in writing and expressly accepted by the seller.
2.2 References to specific conditions of the buyer accepted previously will not be enforceable against the seller, unless agreed upon in writing.
2.3 When a consumer places an online order, a copy of our general terms and conditions of sale is provided to them, in a format they can save or print, at the same time as the order confirmation or at the latest upon delivery.
2.4 If the seller decides to modify its general terms and conditions of sale, it will publish the new version on its website. The buyer is therefore invited to regularly consult these general terms and conditions of sale to become aware of any possible modifications.
2.5 The applicable general terms and conditions of sale will be those in force on the date of the buyer's order.
3.- Order registration and validation
3.1 Browsing the Website
The buyer can view the various products offered by the seller on the website.
3.2 Order Registration
3.2.1 If the customer wishes to place an order, they will choose the different products they wish to purchase by clicking on the "….." tab.
At any time, the buyer can:
- Get a summary of the products they have selected by clicking on the "…." tab;
- Correct any errors made when entering order data or modify the order in the "…" tab;
- Order the selected products by clicking on the "…." tab within the "…." tab.
3.2.2 For certain commercial offers received by the buyer, the latter may benefit from the advantages related to said offer by entering the specific code in the "…." box. The buyer will then specify the promotion code they received and place their order according to the procedure described above.
Should the promotion code not be accepted by the website, the buyer retains the possibility of claiming this promotion by placing their order through other means.
3.2.3 To confirm their order, the buyer must identify themselves on the website after clicking on the following tab, by entering their username and password, which they will have previously created on the "…." tab.
In this regard, the buyer must fully complete, with accurate data, the fields marked with an asterisk in the registration form, particularly mentioning the information necessary for their identification, and especially for natural persons, their first name, last name, postal address, and billing address, as well as, if applicable, their professional activity and VAT registration number; and for legal entities, their company name, legal form, registered office address and any operating offices, billing address, activity, and VAT registration number. In addition, the buyer must provide their e-mail address and a password of their choice, which will be personal and confidential and which they will need to identify themselves later on the website.
3.2.4 Orders for which the buyer has not provided all required information or which are inaccurate or erroneous will be automatically rejected.
3.2.5 The buyer accepts that their registration on the website constitutes proof of their identity and signifies their consent to these general terms and conditions of sale.
3.2.6 Once the customer is identified and has clicked on the "..." tab, an order summary will appear on the website.
3.3 Final validation of the order
The buyer definitively validates the order by clicking on the "..." tab.
3.4 Payment of the order
3.4.1 Once the order has been validated by the buyer, they will be invited to proceed with its payment.
3.4.2 Payment can be made by bank card, Visa, Mastercard, or bank transfer. If the card issuer refuses payment, the seller cannot be held responsible for delivery delays and/or non-delivery of the order. Orders that are not followed by a valid payment in the name of the registered cardholder will neither be accepted nor processed.
3.4.3 The order is complete and the contract becomes definitive upon receipt of payment or when the credit or debit card payment transaction has been approved by the card issuer.
3.4.5 The ordered products remain the exclusive property of the seller until full payment of the order by the buyer.
3.5 Order Summary
As soon as the sale is definitively concluded, an order summary will be sent to the buyer by e-mail as soon as possible.
This summary will include all elements constituting the contract between the parties and serves as proof of the contract.
The invoice sent to the buyer upon delivery of the package will include, in addition to the characteristics of the product(s), the prices of the products as well as, where applicable, the shipping costs of the order.
- Characteristics of the goods and services offered
4.1 The products offered are those listed in the catalog published on the seller's website (http://www.safe-t.eu) with a description. Each product is accompanied by a description. The photographs in the catalog are as accurate as possible but cannot guarantee a perfect similarity with the products offered, especially in case of packaging modification by the seller's partners and suppliers.
These products are offered within the limits of available stock.
If, despite its efforts, all or part of the items are unavailable, the seller will inform the buyer by email as soon as possible and offer them the choice between waiting or canceling the order for unavailable items without cost. Available items will be delivered normally.
4.2 Furthermore, with respect to the data provided by the seller, the latter reserves the right to make or have its partners and suppliers make any improvements and modifications to the products that do not affect the intended use of the product, including aesthetic ones, deemed appropriate or necessary, without the buyer being able to raise objections or having the right to cancel any ongoing orders and/or claim compensation and/or request price reductions.
- Price
5.1 All prices indicated include all taxes. Any transport costs or other administrative fees are indicated in detail and separately during the order process. Unless otherwise agreed and subject to the provisions of these general terms and conditions of sale, taxes (including VAT), transport costs, and insurance are the responsibility of the buyer.
5.2 In no case are the prices indicated during the validation of the order binding for subsequent orders placed by the buyer with the seller.
- Deliveries and delivery times to professional buyers
6.1 Deliveries are made, in accordance with Incoterm 2010, ex works at the Punto It headquarters.
The buyer undertakes to take delivery of the goods within ... days from ..., unless otherwise agreed. Failing to take delivery of the goods within ... days following the fixed date, the sale will be considered terminated by operation of law.
6.2 When goods are shipped by the seller, they always travel at the buyer's risk.
6.3 The seller undertakes, within the limits of its possibilities, to make available to the buyer or deliver the products within the indicative delivery times stated in the order validation. Any delays in delivery shall in no case give rise to compensation and/or damages of any kind, unless otherwise agreed between the parties.
In case of delivery delay, the seller will, as far as possible, contact the buyer to allow them to partially or totally cancel their order or modify the delivery time.
6.4 Deliveries are made subject to availability. The seller reserves the right to make partial deliveries, which will be subject to separate invoicing.
6.5 A delivery made available to the buyer outside the indicative period provided by the seller, for reasons beyond the seller's control, cannot in any way justify the buyer's refusal of the products, nor constitute a reason to claim a price reduction, compensation, or cancellation of the order.
- Deliveries and delivery times to consumers
7.1 Delivery times can vary from 48 hours to 15 working days
- Complaints
8.1 Products must be checked and inspected upon delivery to establish their conformity with the order. In case of apparent problems upon delivery, these must be immediately notified to the seller. At the time of delivery and prior to any consumption of the products, the buyer must check the product data indicated on the product labels (in particular allergens). The buyer expressly waives any action against DNC TAG sprl in case of discrepancy.
8.2 The seller guarantees that the products meet reasonable expectations of reliability and usability upon delivery. It also guarantees that, on the date the sales agreement is formed, the products comply with the applicable legal provisions.
8.3 If the buyer notices a non-conformity or a visible defect, they must immediately, and before the conclusion of the agreement, report it to the seller, failing which they will lose their right. The preceding paragraph does not make an exception to the following:
- The rights recognized by Article 1649bis and following of the Civil Code, insofar as the buyer is a Consumer.
- The rights recognized by Article 1641 and following of the Civil Code, insofar as the buyer is not a Consumer.
- Force majeure
Work stoppages within the seller's company for whatever reason, war, mobilization, flood, fire, loss of operations, strike, lack of sufficient transport, as well as any cause over which the seller has no influence, shall be considered cases of force majeure for the seller, and the latter shall be entitled either to extend the delivery period according to the duration of the impediment, or to cancel the sale, without the buyer being able to claim any right to damages.
- Right of withdrawal (for consumers only)
10.1 The provisions of this article apply only to consumers who purchase items online. This right of withdrawal does not belong to the professional buyer.
10.2 The consumer has the right to inform the seller that they are waiving the purchase, within 14 days from the day following the delivery date of the product, without penalty and for any reason whatsoever. To exercise their right of withdrawal, the consumer must notify the seller of their decision to withdraw from this contract by means of an unambiguous statement (e.g., a letter sent by post, fax, or email).

10.3 In the event of withdrawal from this contract by the consumer, the seller will reimburse all payments received, including, where applicable, delivery costs (with the exception of additional costs arising from the buyer choosing, where applicable, a delivery method other than the least expensive standard delivery method offered by the seller) without undue delay and, in any event, no later than fourteen days after notification of withdrawal.
However, reimbursement will, in any case, be deferred until receipt of the goods.
10.4 The seller reserves the right to no longer sell products to a consumer who has clearly, in the past, misused their right of withdrawal (for example, by repeatedly using this right to harm the seller).
10.5 Only unused goods in their original and undamaged packaging will be accepted for return. They must be accompanied by a copy of the invoice and the dated and signed withdrawal form.
10.6 The costs associated with returning the goods are borne by the consumer.
10.7 The consumer who has purchased products online does not have the right to cancel the purchase, in particular, in the following cases:
- Offers valid while stocks last,
- The supply of goods made to the consumer's specifications or clearly personalized,
- The supply of goods liable to deteriorate or expire rapidly;
- The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed by the consumer after delivery:
- The supply of goods which are, after delivery, according to their nature, inseparably mixed with other items;
- Vouchers or coupons exchanged or completed.
- Sale of tobacco and alcohol or other products that may not be sold to minors
11.1. The seller always has the right to refuse or cancel an Order if there is a prior dispute with the buyer concerned, if the buyer does not use the Website correctly and/or if, on several occasions, the buyer has not collected a confirmed and uncancelled order within the required timeframe.
- Confidentiality
12.1 The seller, responsible for processing the buyer's personal data, undertakes to use the buyer's data exclusively for the purpose of fulfilling their order, sending non-binding information, conducting statistics and tests, and for the overall management of the customer relationship, including, where applicable, for commercial promotion purposes of products and services of its commercial partners.
12.2 The buyer's contact details are also transmitted to the product carriers to ensure reliable shipping.
12.3 The seller treats information confidentially and will not sell or rent it to third parties, unless with the buyer's explicit prior consent.
12.4 The buyer can access, correct, modify or delete their information at any time. They may refuse for the seller to use their data to send them information. A written request is sufficient to the address mentioned above or by e-mail to info@dnctag.com The buyer is responsible for maintaining the confidentiality of their login information and the use of their password.
12.5 The seller undertakes to comply with the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data.
12.6 The seller uses cookies. Cookies are a standard internet technology that allows certain information to be stored and accessed on the user's system. Cookies cannot be used to identify individuals; a cookie can only identify a machine. Any internet user can have protection on their computer and not accept cookies. If the buyer's computer does not accept cookies, they may experience problems during the ordering process. If this is the case, the buyer must contact the seller so that the order can be registered.
- Liabilities
13.1 In the online sales process, the seller is bound only by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service interruption, or other involuntary problems.
13.2 The data on the site is also given in good faith. Any links provided to manufacturers' and/or partners' websites are for informational purposes only. The seller cannot be held responsible for information from these sites.
13.3 Subject to mandatory or public policy provisions applicable to the seller, the seller disclaims all liability for any damage that may be caused by its products, including due to inappropriate use of the products or allergic reactions caused by components expressly mentioned in the user manual or on the product itself.
13.4 The seller cannot be held responsible for any non-compliant or misuse of the products, nor in cases of abandonment, deterioration, modification or negligence in their use and storage.
- Intellectual property
14.1 All elements of the seller's site are and remain the exclusive intellectual property of the seller or its partners and suppliers. No one is authorised to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or audio. Any simple or hypertext link is strictly prohibited without the express prior written consent of the seller.
- Applicable Law - Jurisdiction
15.1 All our sales, as well as these general terms and conditions of sale, are subject to Belgian law.
15.2 Any dispute arising from the execution of these general terms and conditions of sale shall be submitted to the Courts of the seller's registered office, unless mandatory public policy provisions apply and subject to the seller's ability to act before the forum of the buyer's residence or registered office.
